4. Orders, Pricing, and Payments

Risk of loss and title for all merchandise ordered through the Site transfer to you upon our tender of the package to the commercial shipping carrier. 6. Returns, Refunds, and Replacements
All sales of dietary supplements are subject to our return eligibility criteria to safeguard product safety, hygiene, and public health. Unopened, factory-sealed products may be returned within thirty (30) days of verified delivery, subject to customer-funded return postage unless the product arrived damaged, defective, or incorrect. 7. Intellectual Property Rights

10. Limitation of Liability

11. Indemnification
You agree to defend, indemnify, and hold harmless Pro Scalers Global, LLC, its subsidiaries, affiliates, and all of their respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (a) your use of the Site; (b) your breach of these Terms; (c) any violation of the rights of a third party, including intellectual property rights; or (d) any overt harmful act toward any other user of the Site with whom you connected via the Site.
12. Dispute Resolution: Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Any dispute, claim, or controversy arising out of or relating to these Terms, the breach, termination, enforcement, interpretation, or validity thereof, or the use of the Site or purchase of products (collectively, "Disputes") shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules then in effect, except that either party may assert claims in small claims court if the claims qualify. The Federal Arbitration Act (FAA) governs the interpretation and enforcement of this dispute-resolution provision.
YOU AND PRO SCALERS GLOBAL, LLC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator shall have no authority to consolidate claims or administer any class arbitration. Unless mutually agreed upon in writing, any physical arbitration hearings will take place in the State of Delaware.
13. Governing Law and Severability
These Terms and your use of the Site are governed by and construed in accordance with the substantive laws of the State of Delaware, without regard to its conflict of law principles. If any provision or part of a provision of these Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.
